I went to Earnhardt Nissan on 12/04/08. I chose a car and gave them a check for $1000. I did not sign anything or drive the car off the lot. I wanted to see what kind of financing terms resulted first. A few days later the finance office called and said I was approved but in order to "get where I needed to be on payment" I needed to put more money down. I thanked him for his time and declined. He at that time said "do you want to pick up the check or should I shred it". I said "shred it". I assumed this action would take place because of the longevity and reputation of the dealership. On February 6, 2009 the check for the car that I never signed any document for nor did I drive off the lot was deposited into my bank. I called the dealership and was treated rudely by everyone I spoke to. The business office was closed due to it being a Saturday. I had to go the weekend with no money. I called my bank and the representative from the bank said,"unfortunatly we see the more and more today especially due to the economy. People are desperate. You are entitled to your money back because a transaction did not take place. If you are laid back in this situation, you may never get your money back. You might have to get nasty with them." I have other items pending to clear my accout and the bank also told me the dealership would be responsible for any overdraft fees. I am going to the business office tomorrow to try to resolve this matter. I have to take off work to do so. I understand my part in this issue. I should have picked up the check. However, I trusted Earnharddt Nissan to be above board with any business deal. I trusted them to keep their word to shred my check. I did so because of the scale of their size and the fact that I did not sign a contract, I did not drive the car and I did not end up purchasing anything from them. The banker's statements is a warnign to any consumer looking to purchase a car. The economy is making them desperate and they will do anything to scam you. Just because I could not afford to put more money down did not give them the right to deposit the check they said they would shred. I was very shocked and disappointed. Not to mention the hardship it has caused so far and the hardship that I hope does not happen if they do not refund the money promptly.
the people at Earnhardt Nissan are the very best at what they do...buying my last 4 cars from them was a nice change from the corprate owned stores..Earnhardt's is family owned. I only had one small problem and they fixed it very quickly
These guys are liars and fatmouths. Good luck getting them to hold up to their promises after you leave the dealership with your new car!
